About this Privacy Statement

Orbit Farms, LLC (“Orbit”, we, or us”), is committed to protecting your privacy. This Privacy Statement applies to our website, mobile applications or any other sites hosted by our service providers on our behalf (collectively the “Sites”). This Statement describes the information that we collect, the purposes for which it is used, and your choices regarding our use of it. Your use of our Sites is subject to the data practices described in this Statement; however, for text (SMS) messaging and other communications that require your consent under applicable law, we rely on your affirmative, express opt-in rather than your mere use of the Sites, and you may withdraw that consent at any time as described in this Statement.

Types of Information We Collect

The personal information that we collect about you can be divided into two categories, personally identifiable information and non-personal data. Personally identifiable information means information that specifically identifies you as an individual. Non-personal data is information that does not identify you.

Personally Identifiable Information

You can visit our Sites without providing us with any personally identifiable information. In some instances, however, we may ask that you provide us with personally identifiable information so that we can provide you with a service or carry out a transaction that you have requested. In these instances, the personally identifiable information that we collect may include:

• Contact details, such as your name, job title, company/organization name, website, telephone number, and email address; and
• Information about service or technical requests you have initiated for our products or services. You are not required to provide any of this personally identifiable information, but if you do not, we may not be able to provide you the requested service, complete your transaction. If you make an application for a position with Orbit we may collect the following information from you through our online portal:
• Resume or CV, cover letter, previous work experience, educational background, type of employment sought, date available, employee referral, desired salary, travel preferences, information about your performance and career developments; and
• Your name, email address, and phone number; and
• Any other information you submit to us, including any correspondences you may have with us.

Non-Personal Data

We also collect non-personal data that does not identify you, directly, including “automatically collected data,” “aggregated” or “anonymized” information that we collect to inform us how others use our Sites. Non-personal data includes, (i) device software platform, operating system, type of Internet browser, and firmware; (ii) mobile phone carrier; (iii) web browsing patterns, including websites visited; (iv) geographical data such as zip code, area code, and other non-precise location information; and (v) the way in which you use the Site, including frequency and duration of usage.

Cookies and Similar Technologies

A cookie is a text file that is downloaded on to your hard disk or into your browser's memory by a webserver that allows us to monitor your interaction with our Sites. Cookies cannot be used to run programs or deliver viruses to your computer, read data from elsewhere on your computer, or misappropriate any personally identifiable information about you. Cookies are uniquely assigned to you, and can only be read by a webserver in the domain that issued you the cookie. Cookies are useful because they help arrange the content and layout of our Sites and allow us to recognize those computers or other devices that have been to our Sites before. Cookies do many different jobs, such as allowing our Sites to remember your preference settings and helping us to enhance the usability and performance of our Sites and your experience using it; for example, a cookie could store your personally identifiable information that you have entered into a form on our Site. How We Use the Information We Collect

We may use your personal information for the following purposes:

Services and Transactions

We may use your personal information to deliver services to you or carry out transactions you have requested, including, but not limited to, providing information on our products or services you have purchased or otherwise use, registering purchased products, processing product orders, handling warranty claims, replacing product manuals, answering customer service requests and facilitating the use of our Sites. We may also use your personal information to send you email or postal mail, provide customer support, or arrange for deliveries. As part of delivering services, we may share your information with our distributors. We provide these companies with only those elements of your personal information they need to deliver those services. Mobile Marketing and Text Messaging (SMS)

If you provide us with your mobile telephone number, we may send you text (SMS) messages for the purposes you have consented to below. Message frequency may vary, and message and data rates may apply. Consent to receive marketing or promotional text messages is not a condition of purchasing any goods or services. You may opt out at any time by replying STOP to any message, and you may reply HELP for assistance. You may select any or all of the following options:

Mobile information or text messaging opt-in data and consent will not be sold or shared with third parties or affiliates for their marketing or promotional purposes.

We use your personally identifiable information for processing employment applications. If you are not hired, we will retain your application information for a period of 24 months to consider you for future opportunities, unless you direct us to delete it sooner or a longer retention period is required by law. If you accept a position with Orbit, we will retain this information as part of your employment record for the duration of your employment and for the retention period required by applicable law thereafter.

Compulsory Disclosure

We may also disclose your personal information if we are required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on us; (b) protect and defend our rights or property; or (c) act under exigent circumstances to protect the personal safety of any individual.

Security of your personal information

Orbit is committed to protecting your personal information. We maintain reasonable administrative, technical, and physical safeguards designed to protect your personal information from unauthorized access, use, alteration, or disclosure. These safeguards may include, as appropriate to the sensitivity of the information, access controls and role-based permissions, encryption of data in transit and at rest, network and endpoint security measures, monitoring and logging, and storage of personal information on servers in controlled, secure environments. We periodically review and update our security practices. However, no method of transmission over the Internet or method of electronic storage is completely secure, and we cannot guarantee its absolute security.

Your rights to your information

You may have certain rights with respect to personal information about you that is collected through the Sites or when you contact us. The rights that apply to you depend on where you live and the laws of your country or, for U.S. users, your state of residence. If you are a resident of a U.S. state with a comprehensive privacy law (including, for example, California, Virginia, Colorado, Connecticut, Utah, Texas, Oregon, and Montana), or of the European Union, some or all of the rights described below may apply to you. If we decline to take action on your request, you may appeal that decision by contacting us using the contact details at the end of this Statement. We will respond to your appeal within the time period required by applicable law and will inform you in writing of our decision and the reasons for it. If your appeal is denied, you may contact the attorney general or other supervisory authority in your state. We will respond to any requests from you to exercise your rights within the timeframes required by law. We may charge a fee to facilitate your request where permitted by law. If you believe our processing of your personal information does not comply with data protection law, you can make a complaint to the supervisory authority in charge of overseeing compliance with data protection law in your jurisdiction. We would however appreciate the chance to address your concerns, so please feel free to contact us regarding any complaint you may have. Some web browsers may transmit “do-not-track” (DNT) signals to the Sites with which the user communicates. Because there is not yet a common industry standard for how to interpret DNT signals, we do not separately respond to browser DNT signals at this time. However, where required by applicable law, we recognize and honor opt-out preference signals, including the Global Privacy Control (GPC), transmitted by your browser or device as a valid request to opt out of the “sale” or “sharing” of your personal information for residents of states that provide this right. Children’s information

We do not knowingly collect personal information from children and do not target or direct our Sites to children. For users in the United States, “children” means individuals under the age of 13, consistent with the Children’s Online Privacy Protection Act (COPPA). If we learn that we have collected personal information from a child under 13 without verifiable parental consent, we will promptly delete it. In other jurisdictions, the meaning of “children” is subject to applicable local law.

California privacy statement

Pursuant to Section 1798.83 of the California Civil Code, residents of California can obtain certain information about the types of personal information that companies with whom they have an established business relationship have shared with third parties for direct marketing purposes during the preceding calendar year. The law provides that companies must inform consumers about the categories of personal information that have been shared with third parties, the names and addresses of those third parties, and examples of the types of services or products marketed by those third parties. California Consumer Privacy Act (CCPA/CPRA)

If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, the “CCPA”), provides additional rights regarding your personal information. This section supplements the rest of this Statement and applies to personal information we collect about California residents, including our business contacts and job applicants. In the preceding twelve (12) months, we have collected the categories of personal information described in the “Types of Information We Collect” section above, including identifiers (such as name and contact details), professional or employment-related information, education information, internet or other electronic network activity information, geolocation data, and sensitive personal information (such as Social Security and government identification numbers and, where applicable, information concerning heritage or ethnicity). We collect this information from the sources, and use and disclose it for the business and commercial purposes, described in this Statement, and we may disclose it to service providers, distributors, and other third parties as described above. We do not sell your personal information for monetary consideration. However, our use of certain cookies and analytics or advertising technologies may be considered a “sale” or “sharing” of personal information under the CCPA. You have the right to opt out of the sale or sharing of your personal information and to limit our use of your sensitive personal information to the purposes permitted by law. Subject to certain exceptions, California residents have the right to: (i) know and access the specific pieces and categories of personal information we have collected; (ii) request deletion of their personal information; (iii) request correction of inaccurate personal information; (iv) opt out of the sale or sharing of personal information; (v) limit the use and disclosure of sensitive personal information; and (vi) not be subject to discrimination or retaliation for exercising these rights. To exercise your right to know, delete, or correct, to opt out of the sale or sharing of your personal information, or to limit the use of your sensitive personal information, please contact us using the contact details at the end of this Statement or use the “Do Not Sell or Share My Personal Information” and “Limit the Use of My Sensitive Personal Information” mechanisms made available on our Site. We also honor opt-out preference signals such as the Global Privacy Control (GPC). We will verify your request as required by law, and you may use an authorized agent to submit a request on your behalf. If we deny your request, you may appeal as described in the “Your rights to your information” section above.

Changes to this statement

We may occasionally update this Statement to reflect company and customer feedback. When we do, we will revise the "last updated" date at the top and bottom of the Privacy Statement and take such additional steps as may be required by law. We encourage you to periodically review this Statement to be informed of how we use and protect your information.
